Enter to win a chance to meet Default and see them perform live in concert.

TELUS clients who send a text message of “WIN” +  city keyword code (see below) to short code 5588 on their TELUS PCS handset between October 8, 2009, 12:00 PM Eastern time and October 27, 2009, 11:59 PM Eastern Time automatically receives one (1) entry into the contest.  Entrants can participate as many times as they like.  Standard fee of $.15 applies to each text message (free on some text message bundles).

NO PURCHASE NECESSARY: To enter and be eligible for the prize without purchase, complete all of the following information on a plain white piece of paper and mail it to:

Include the following required information: Your full name, age, complete mailing address, daytime telephone number, your e-mail address, and the name of the contest. To be eligible, entries must be received at the specified address by October 27, 2009, 11:59 PM Eastern Time. Entrants can participate as many times as they like but TELUS will only accept one mailed-in form per stamped envelope.  Each entry form will give a contestant one ballot to participate in the contest.

The awarded prize will consist of two (2) tickets to a Default concert (the “Prize”) and an opportunity to meet (pending artist availability) Default in the city specified by you in your text message entry.  There are eight (8) prizes to be won – one winner for each concert venue listed below.  Retail value of each Prize is approximately $120 CAN per pair of tickets.

All costs and expenses incurred in using the prize and which are not outlined in this prize description are the sole responsibility of the winner and their guest.  If Winner is unable to attend the event on the date of the show they have entered, Winner shall forfeit all rights to the Prize.  No responsibility is assumed by TELUS or EMI Music Canada (the “Sponsors”) for cancelled, delayed, suspended or rescheduled events after ticketing for any reason whatsoever beyond its control, or if other factors beyond their reasonable control prevent the Prize or any part thereof from being fulfilled. In any such event, the Prize winner will not be provided with a substitute prize or cash equivalent or any part thereof. Further, the Sponsors assume no liability or responsibility whatsoever should the Winner or his/her guest be denied entry to the venue, for any reason whatsoever.  In the event that the Winner and guest arrive at the Destination, and the artist is unable to perform or fails to perform for any reason whatsoever, the Prize shall be deemed to be fulfilled. 

Prize must be accepted as awarded and is not redeemable for cash or transferable.  No substitutions allowed except at Sponsor’s sole discretion.

TELUS does not accept entries for this contest by phone, fax, or e-mail and does not accept reproductions or copies of ballots. 

To be eligible for the Prize, an entrant’s text message must take place or the entrant’s mailed-in ballot must be received by the contest closing date of  October 27, 2009, 11:59 PM Eastern Time.  All entries become property of TELUS, which assumes no responsibility for lost, stolen, delayed, damaged or misdirected entries during the promotional period, for any problems or technical malfunction of any failure of any entry to be received by TELUS on account of technical problems or failure of handset or mobile web browser, or any combination thereof including any injury or damage to an entrant's or any other person's computer related to or resulting from this promotion. TELUS reserve the right, at their sole discretion, to terminate, cancel or suspend this contest at any time. Entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way. Entrants agree to abide by the contest rules.

A random draw for all 8 Prizes will take place at the TELUS office located at 200 Consilium Place, Scarborough, on or about  November 14, 2009 (after 12:00 Noon EST) by a TELUS representative.  The selected entrants will be notified by telephone within two business days of the draw. If the selected entrants cannot be reached within 24 hours or 3 attempts to contact, whichever first, or if a selected entrant does not meet all of the contest rules, another entrant will be selected from the remaining eligible entries. To win, the selected entrant must correctly answer, unaided, a time-limited mathematical skill-testing question to be administered by telephone at a pre-arranged mutually convenient time. 

This contest is open to all individuals who are residents of Canada and have reached the age of eighteen in the jurisdiction where they reside at the time of entry excluding employees of TELUS and the Sponsor and their advertising and promotional agencies, and members of their respective immediate families and any person domiciled with any of the above.  Entrants who have won any prize from TELUS within the last 60 days are ineligible to enter the contest or win a prize and will be disqualified. Entrants under the age of majority are eligible to win the Prize described herein, provided that the winning entrant’s parent or legal guardian accepts the Prize on his/her behalf. No telephone contact or correspondence will be entered into except with the winning entrant.

To claim the prize, the winning entrant or, if a winning entrant is under the age of majority, his/her parent or a legal guardian, must sign a standard form waiver confirming their acceptance and compliance with contest rules and releasing the Sponsor, their affiliated entities and partnership interest holders, and each of their directors, officers, employees, representatives, advertising and promotional agencies from any and all liability arising out of, pursuant to, or as a result of the carrying out of the contest including liability arising from the promotion and acceptance of and usage of the prize as awarded.

All entrants that are customers of TELUS at the time of entry and/or at the time of prize awarded must have their TELUS accounts in good standing (with a current account balance or one that is no more than 30 days past due).

The chances of winning are dependent upon the total number of entries received.  This contest is subject to all federal, provincial and municipal laws and regulations.

Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling.

Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

By entering the contest, entrants consent to: (a) the use of their names, city of residence, photograph, voice and/or image on video tape for publicity purposes in all media used by TELUS.  Entrants agree to TELUS’ use of the entrants personal information as described in TELUS’ privacy policy located at www.telus.com.
